Welcome to Dawam, a Life-Critical Asset Intelligence platform provided by WeSimplifAI Private Limited (“WeSimplifAI,” “we,” “us”). These Terms of Use govern your access to and use of the Dawam website, application and related services (the “Service”). By accessing or using Dawam, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to accept these Terms on its behalf. If you do not agree, please do not use Dawam.
Dawam provides a Life-Critical Asset Intelligence platform designed to bring together and contextualize the information surrounding physical equipment — including equipment identity, specifications, documentation, service and calibration history, observations, condition signals, configurations, regulatory status, relationships and other operational context.
Dawam uses software and AI-based capabilities to help users understand equipment, surface relevant context, identify information that may deserve attention, and support operational decision-making. Dawam is an intelligence layer — it does not replace your organization’s authoritative HTM, EAM, CMMS, financial or other enterprise systems.
Dawam is not a clinical decision-support or diagnostic tool. It reasons about equipment readiness, never about a patient’s condition or treatment, and must not be used as a substitute for qualified clinical or biomedical engineering judgment.
You must be at least 18 years old to create a Dawam account. The Service is intended for organizational and operational use by healthcare and related organizations, and is not directed at children.
You must be authorized to use Dawam on behalf of any organization for which you create or use an account. You are responsible for providing accurate account information, maintaining the security of your credentials, and all activity conducted through your account. Notify us promptly if you believe your account has been accessed or used without authorization.
You retain ownership of the data, documents, specifications, records and other information you provide to or connect with Dawam (“Customer Data”). You grant WeSimplifAI the limited rights necessary to host, process, transmit, display and otherwise use Customer Data solely as necessary to provide, operate, secure and support the Service.
Customer Data must not include patient-identifying information. You are responsible for ensuring you have the necessary rights and permissions to provide Customer Data to the Service, and you should not provide information you are not authorized to disclose or process.
Dawam — including its software, technology, interfaces, designs, algorithms, models, documentation and branding — remains the property of WeSimplifAI or its licensors. These Terms do not transfer ownership of the Service or its underlying technology to you.
Dawam provides contextual intelligence, insights, anomaly signals and recommendations to assist human decision-making about equipment. Dawam does not act as an autonomous operational authority, and its AI layer cannot itself change a device’s Availability Status — only an authorized human action may do so.
Information generated or inferred by Dawam may be incomplete or inaccurate and should be evaluated against appropriate source information, operational procedures and professional judgment. Your organization and its authorized personnel remain responsible for verifying equipment information, determining operational and Availability Status, executing maintenance or calibration actions, and ensuring appropriate safety and regulatory compliance. A qualified biomedical engineer, clinician or authorized staff member always makes the final determination that equipment is fit for use.
Dawam may recommend. It does not silently become the authority over your equipment’s operational state.
You agree not to:
Dawam may integrate with or operate alongside third-party systems, including HTM, EAM, CMMS, cloud, operational or other business software. Your use of third-party systems remains subject to the applicable terms of those providers. Where you authorize Dawam to connect to a third-party system, you are responsible for maintaining the necessary permissions and authorizations for that connection. WeSimplifAI is not responsible for the availability, accuracy, security or operation of third-party systems or information supplied by them.
We aim to provide a reliable Service, but Dawam is provided on an “as is” and “as available” basis to the extent permitted by applicable law. We do not guarantee that the Service will always be uninterrupted, error-free or available at all times.
We may modify, improve, suspend or discontinue features of the Service from time to time, and may update these Terms when reasonably necessary to reflect changes to the Service, legal requirements or our practices. Where appropriate, we will provide notice of material changes.
You may stop using the Service at any time. We may suspend or terminate access where you materially breach these Terms, misuse the Service, fail to pay applicable fees, or where suspension is reasonably necessary to protect the Service, its users or our systems.
Upon termination, your right to access the applicable Service will end, subject to any provisions intended to survive termination. Any subscription-specific termination or data-retention provisions may be governed by the applicable commercial agreement.
Dawam is intended to help organizations understand their life-critical equipment and make better operational decisions. We do not guarantee that Dawam will identify every equipment issue, anomaly, failure or maintenance requirement, or that its outputs will always be accurate, complete or current. Dawam should be used together with appropriate operational controls, procedures, professional judgment and authoritative information, and never as a substitute for qualified clinical or biomedical engineering sign-off.
To the maximum extent permitted by applicable law, WeSimplifAI will not be liable for indirect, incidental, consequential, special or punitive damages arising from or relating to use of the Service.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited under applicable law.
These Terms are governed by the laws of India, without regard to conflict-of-law principles.
Any dispute arising from or relating to these Terms or the Service will be subject to the jurisdiction of the courts having jurisdiction over the registered office of WeSimplifAI Private Limited, subject to applicable law.
